Please read these terms carefully before booking. By using our services, you accept these terms and our liability limitations for adventure activities.
1. Acceptance of Terms
By accessing or using the Solive Travel website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and Solive Travel (referred to as "we," "us," or "our"), a travel and tourism operator registered in Kenya.
2. Services Provided
Solive Travel provides:
- Adventure travel packages including camping, hiking, safaris, beach excursions, and cultural tours
- International and regional travel arrangements across Africa and beyond
- Club memberships including book clubs, business networking clubs, and swimming lessons
- Online booking and payment processing services
- Travel planning and consultation services
3. Booking and Payment Terms
3.1 Booking Process
- All bookings must be made through our website or authorized channels
- A valid email address and phone number are required for booking confirmation
- Bookings are subject to availability and confirmation by Solive Travel
- You will receive a booking reference number upon successful booking
3.2 Payment Options
We offer flexible payment options:
- Full Payment: Pay 100% upfront to secure your booking
- Deposit Payment: Pay a deposit (typically 50%) with balance due before departure
- Custom Payment Plan: Arrange installment payments as agreed
3.3 Accepted Payment Methods
- M-Pesa mobile money transfers
- Credit/Debit cards
- Bank transfers
3.4 Payment Deadlines
- Full payment must be received at least 14 days before departure date unless otherwise agreed
- Failure to make payment by the due date may result in booking cancellation
- Payment confirmations will be sent via email within 24 hours of payment receipt
4. Cancellation and Refund Policy
4.1 Cancellation by Customer
- More than 30 days before departure: 80% refund (20% cancellation fee)
- 15-30 days before departure: 50% refund (50% cancellation fee)
- 7-14 days before departure: 30% refund (70% cancellation fee)
- Less than 7 days before departure: No refund
- No-show or cancellation on departure day: No refund
4.2 Cancellation by Solive Travel
We reserve the right to cancel trips due to insufficient bookings, weather conditions, safety concerns, or force majeure events. In such cases, customers will receive a full refund or the option to transfer to an alternative trip of equal value.
4.3 Refund Processing
- Refunds will be processed within 14-21 business days
- Refunds will be made to the original payment method
- Bank charges or transaction fees are non-refundable
5. Assumption of Risk and Liability Waiver
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND REQUIRES YOU TO ASSUME CERTAIN RISKS.
5.1 Inherent Risks
You acknowledge that adventure travel activities including but not limited to hiking, camping, safaris, mountain climbing, water sports, cultural expeditions, and wildlife viewing involve inherent risks including:
- Physical injury, illness, or death
- Accidents during transportation, hiking, or other activities
- Wildlife encounters and unpredictable animal behavior
- Adverse weather conditions and natural disasters
- Remote locations with limited medical facilities
- Risks associated with high altitude, water activities, and extreme terrain
- Equipment failure or malfunction
5.2 Voluntary Participation
By booking and participating in our trips, you voluntarily assume all risks associated with these activities. You confirm that you are physically and mentally fit to participate and have disclosed any medical conditions that may affect your ability to safely participate.
5.3 Release from Liability
To the maximum extent permitted by Kenyan law, you agree to release, indemnify, and hold harmless Solive Travel, its directors, employees, agents, guides, and contractors from any and all liability, claims, demands, actions, or causes of action arising from:
- Personal injury, illness, or death during any trip or activity
- Loss or damage to personal property
- Any acts or omissions of third-party service providers (hotels, transport operators, activity providers)
- Weather conditions, natural disasters, or acts of God
- Political unrest, terrorism, or civil disturbances
- Your own negligence or failure to follow safety instructions
5.4 Insurance Requirement
All participants are STRONGLY RECOMMENDED to obtain comprehensive travel insurance covering:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Personal accident and death coverage
- Lost or damaged luggage and personal effects
Solive Travel is not liable for any costs arising from lack of adequate insurance coverage.
6. Customer Responsibilities
6.1 Health and Fitness
- You must be in good health and physical condition suitable for the activities
- You must disclose any medical conditions, disabilities, or special requirements at booking
- You must follow medical advice regarding vaccinations and prophylaxis for your destination
- You are responsible for carrying necessary medications and medical supplies
6.2 Travel Documents
- Valid passport (with at least 6 months validity)
- Necessary visas and permits for destinations
- COVID-19 vaccination certificates or test results as required
- Any other documentation required by authorities
6.3 Conduct and Behavior
- Follow instructions from guides and tour leaders at all times
- Respect local customs, cultures, and laws
- Not engage in illegal activities or behaviors that endanger yourself or others
- We reserve the right to remove participants who breach these conditions without refund
7. Trip Changes and Force Majeure
We reserve the right to modify itineraries, accommodation, or activities due to:
- Weather conditions, natural disasters, or environmental factors
- Political instability, civil unrest, or security concerns
- Government restrictions or travel advisories
- Pandemics or health emergencies
- Unavailability of services or facilities
- Safety concerns or force majeure events beyond our control
In such cases, we will endeavor to provide suitable alternatives. We are not liable for any additional costs incurred due to such changes or delays.
8. Pricing and Fees
- All prices are quoted in Kenyan Shillings (KES) unless otherwise stated
- Prices include services as specifically stated in the trip description
- Prices exclude travel insurance, visa fees, vaccinations, and personal expenses unless specified
- We reserve the right to adjust prices due to currency fluctuations, fuel surcharges, or government tax changes
- Price increases will not apply to confirmed bookings that are fully paid
9. Accommodation and Transportation
- Accommodation standards vary by destination and trip category (luxury, budget, camping, etc.)
- Room/tent allocations are based on booking information (single, double, family)
- Transportation safety standards comply with local regulations
- We use reputable third-party providers but are not liable for their acts or omissions
- Delays in transportation due to weather, mechanical issues, or other factors are beyond our control
10. Club Memberships
10.1 Membership Terms
- Club memberships are valid for 12 months from activation date
- Annual membership fees are non-refundable after 14 days of activation
- Members must register for events in advance subject to availability
- Membership benefits are as described on the club pages and may be updated
10.2 Membership Cancellation
- Members may cancel within 14 days of purchase for a full refund
- After 14 days, memberships are non-refundable but remain valid until expiry
- We may terminate memberships for breach of conduct or club rules
11. Medical and Emergency Situations
- Participants requiring medical attention will be assisted to the nearest facility
- All medical costs are the responsibility of the participant
- Emergency evacuation costs must be covered by participant or their insurance
- We are not responsible for quality or availability of medical care in remote areas
- Participants must provide emergency contact information and consent for emergency medical treatment
12. Minors and Vulnerable Persons
- Minors (under 18 years) must be accompanied by a parent or legal guardian
- Parent/guardian accepts full responsibility for the minor's safety and conduct
- Special needs or requirements must be disclosed at booking
- We reserve the right to refuse participation if we deem activities unsuitable for minors or vulnerable persons
13. Intellectual Property
- All content on this website is owned by or licensed to Solive Travel
- Photos and videos taken during trips may be used for marketing purposes unless you opt out
- You may not reproduce, distribute, or commercially use our content without written permission
14. Data Protection and Privacy
Your personal data is processed in accordance with the Kenya Data Protection Act, 2019 and our Privacy Policy. By using our services, you consent to data collection and processing as described.
15. Complaints and Disputes
15.1 Complaint Process
- Complaints should first be raised with your guide or tour leader during the trip
- If unresolved, submit written complaints within 14 days of trip completion

- We aim to respond to complaints within 7 business days
15.2 Dispute Resolution
Any disputes arising from these terms shall be resolved through:
- Good faith negotiation between parties
- Mediation under the auspices of a mutually agreed mediator
- If unresolved, arbitration under the Arbitration Act, 1995 (Kenya)
- Legal proceedings in the courts of Kenya shall be a last resort
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Solive Travel's total liability is limited to the amount paid for the specific booking
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for acts or omissions of third-party service providers
- We are not liable for events beyond our reasonable control (force majeure)
- We do not guarantee exact timing, routes, or specific inclusions where circumstances require changes
17. Photography and Media
- Photos and videos may be taken during trips for promotional purposes
- By participating, you consent to appear in such media unless you opt out in writing
- Opt-out requests must be submitted at least 7 days before trip departure
- You retain rights to your own photos but grant us a license to use trip photos for marketing
18. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Kenya, and you consent to the jurisdiction of such courts.
19. Amendments
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms. For significant changes, we will notify customers via email.
